Terms & Conditions of Hire (Split: Consumer & Corporate)
1. Definitions
“Supplier” means Zinn Photo Booth Hire.
“Client” means the individual or organisation booking the services.
“Equipment” means all photo booth equipment supplied, including booth, camera, backdrops, stands, storage devices, and accessories.
“Event” means the hired function or booking.
PART A – CONSUMER HIRE TERMS
(Private individuals booking outside the course of business)
A1. Responsibility for Equipment
The Client agrees to take reasonable care of the Equipment from the time it is made available at the Event until collection by the Supplier.
A2. Damage, Loss or Theft
The Client is liable for loss of or damage to the Equipment to the extent caused by:
Their negligence or breach of these terms
The actions or omissions of their guests or attendees
The Client is not liable for fair wear and tear, inherent faults, or loss caused solely by the Supplier’s negligence.
A3. Insurance
Where the Client holds relevant event or venue insurance, this shall be used as the primary means of recovery where applicable. The Client is not required to obtain insurance unless legally obliged.
A4. Financial Liability & Replacement Values
Where insurance does not apply or is insufficient, liability is capped at the reasonable cost of repair or replacement, subject to the following maximum values:

External hard drive: £99.99
Backdrop curtains vary by theme and shall be charged at actual replacement cost.
A5. Props and Consumables
Props are classed as consumables. Reasonable wear is included. Deliberate or excessive damage may be charged.
A6. Loss of Business (Liquidated Damages)
If damage renders the Equipment unavailable for future bookings, the Client agrees to pay a charge equal to one missed event, based on the Supplier’s standard hire rate. This represents a genuine pre- estimate of loss.
A7. Legal Rights
Nothing in these terms limits statutory rights under the Consumer Rights Act 2015 or liability for death or personal injury caused by negligence.
PART B – CORPORATE HIRE TERMS
(Bookings made wholly in the course of business)
B1. Business Status
The Client confirms this booking is made on a business-to-business basis. Consumer protection legislation does not apply.
B2. Responsibility and Supervision
The Client accepts full responsibility for the Equipment from setup to collection and shall ensure adequate supervision and protection.
B3. Loss, Damage or Theft
The Client is liable for any and all loss, theft, or damage, howsoever caused, except where caused solely by the Supplier’s gross negligence or wilful misconduct.
B4. Insurance
The Client warrants that it maintains adequate insurance. Such insurance shall respond as the primary policy.
B5. Indemnity
The Client shall fully indemnify Zinn Photo Booth Hire against all losses, claims, damages, and costs arising from use of the Equipment.
B6. Replacement Values
New-for-old replacement costs apply as follows:

B7. Loss of Business
Loss of availability resulting from damage shall incur a one missed event fee, recoverable as liquidated damages.
B8. Late Payment
Interest and recovery costs may be charged under the Late Payment of Commercial Debts (Interest) Act 1998.
PART C – OPTIONAL DAMAGE WAIVER (Consumer & Corporate)
C1. Damage Waiver Option
The Client may opt to purchase a Damage Waiver for £100, which limits financial liability for accidental damage only to the Equipment.
C2. What the Damage Waiver Covers
Where purchased, the Damage Waiver:
Waives charges for accidental, non-deliberate damage
Caps repair or replacement charges for covered damage
C3. What the Damage Waiver Does NOT Cover
The Damage Waiver does not apply to:
Theft or unexplained disappearance
Deliberate, reckless, or malicious damage
Damage caused by intoxication or misuse
Electrical or power-related damage due to unsafe supply
Loss of business or missed-event charges
Legal, reputational, or administrative losses
The Supplier expressly reserves the right to pursue non-financial and consequential losses not covered by the waiver.
This is justified and lawful: a damage waiver is not insurance and does not need to extinguish all liability. Courts accept exclusions where they are clear, optional, and proportionate.
PART D – Booking Confirmation & Mandatory Acknowledgement
Booking Confirmation Requirement
No booking is confirmed until the Client has explicitly acknowledged the following. By paying the deposit, the Client confirms acknowledgement of these terms:

☐ I have read and agree to the relevant Terms & Conditions
☐ I accept responsibility for the Equipment during the Event
☐ I acknowledge the stated replacement values and loss-of-business provisions ☐ I confirm whether I accept or decline the optional £100 Damage Waiver
☐ I understand that offensive, explicit, or inappropriate use of the photo booth is prohibited and may result in immediate suspension without refund.
Acceptance is assumed by the client paying their deposit, to secure the booking. This confirmation shall constitute binding agreement with the stated terms.
PART E – Booking Information, Packages & Payment Terms
E1. Booking Process
A booking with Zinn Photo Booth Hire is only secured once:
The required booking deposit has been paid in cleared funds; and
The Client has completed the mandatory booking confirmation and acknowledgement set out in Part D of these Terms.
Verbal enquiries or provisional holds do not constitute a confirmed booking. E2. Booking Deposit
All packages require a non-refundable booking deposit of £80.
The deposit:
Secures the event date and time
Covers administrative costs and loss of opportunity
Is non-refundable under all circumstances, including cancellation, postponement, or reduced attendance
The deposit is not transferable to alternative dates unless expressly agreed in writing by the Supplier.
E3. Package Pricing and Inclusions
The following packages are offered at the time of booking:
Basic Package
£80 non-refundable booking deposit
£200 hire fee
3 hours of Photo Booth use
Photo Booth unit and backdrop only
Full interactive digital features
No props supplied (Client provides their own)
Standard Package
£80 non-refundable booking deposit
£295 hire fee
5 hours of Photo Booth use Props package included Standard backdrop included Full interactive digital features Gold Package
£80 non-refundable booking deposit
£350 hire fee
Up to 8 hours of unlimited Photo Booth use
Props package included
Themed booth and backdrop (e.g. Christmas, Night at the Oscars, 80s Disco or similar)
Digital guest book supplied on USB thumb drive
Themes are subject to availability and must be selected in advance.
E4. Balance Payment
The remaining balance (after the £80 deposit) must be paid no later than 7 days before the Event, unless otherwise agreed in writing.
Failure to pay the balance by the due date may result in:
Cancellation of the booking without refund of the deposit; and
Reallocation of the date to another client.
E5. Package Changes and Upgrades
Package upgrades may be requested subject to availability and must be confirmed in writing. Downgrades after booking are not permitted once the deposit has been paid.
E6. Event Duration and Overtime
Use of the Photo Booth is limited to the duration specified in the booked package.
Any extension beyond the agreed hire period is subject to:
Availability
Additional charges at the Supplier’s prevailing hourly rate
Unauthorised use beyond the agreed time may be treated as misuse under the Damage, Loss and Indemnity provisions.
E7. Props and Client-Supplied Items
Where clients supply their own props (Basic Package), Zinn Photo Booth Hire accepts no responsibility for loss, damage, or suitability of such items.
Client-supplied props must not pose a safety risk or risk of damage to the Equipment.
E8. Pricing Validity
All prices are quoted in GBP (£) and are valid at the time of booking. Prices may be amended for future bookings without notice but will not affect confirmed bookings.
PART F – Rescheduling & Postponement
F1. Definition of Rescheduling
“Rescheduling” means any request by the Client to change the confirmed event date and/or time after a booking has been confirmed.
F2. Rescheduling Requests
Rescheduling requests must be made in writing and are subject to:
Availability of Zinn Photo Booth Hire on the proposed new date; and
Written confirmation of acceptance by the Supplier.
The Supplier is under no obligation to offer alternative dates.
F3. Effect on Booking Deposit
The £80 booking deposit is non-refundable in all circumstances.
Where rescheduling is approved, the deposit may be credited once only towards a new date, provided the conditions in F4 are met.
F4. Notice Periods and Conditions
Rescheduling may be permitted on the following basis:
More than 30 days’ notice before the Event
One reschedule permitted, subject to availability
Deposit credited to the new date
Any price difference between dates or packages must be paid
14–30 days’ notice before the Event
Reschedule at the Supplier’s discretion
Deposit credited once, subject to availability
An administrative rescheduling fee of £50 may apply
Less than 14 days’ notice before the Event
Rescheduling is not permitted
The booking shall be treated as a cancellation
The deposit is forfeited and any additional sums due remain payable in accordance with these Terms These notice periods reflect genuine administrative costs and loss of opportunity.
F5. Limits on Rescheduling
Only one reschedule per booking is permitted.
If a rescheduled booking is subsequently cancelled or further rescheduled, the booking shall be treated as cancelled and all sums paid shall be forfeited.
F6. Package Changes on Reschedule
Any rescheduled booking:
Must be for the same or higher-value package
Is subject to current pricing at the time of rescheduling
Downgrades are not permitted.
F7. Supplier-Initiated Rescheduling
In the unlikely event that Zinn Photo Booth Hire is required to reschedule due to circumstances beyond reasonable control (including equipment failure, serious illness, or force majeure), the Client will be offered:
An alternative date; or
A full refund of all sums paid
This does not affect the Client’s statutory rights.
F8. Corporate Bookings
For corporate bookings, rescheduling is subject to written agreement only and may be refused without reason. Any approved reschedule may be subject to revised pricing and additional costs.
PART G – Improper or Inappropriate Use of Photo Booth Equipment
G1. Acceptable Use
The Equipment must be used in a lawful, respectful, and appropriate manner at all times.
The Client is responsible for ensuring that all users of the Equipment (including guests and attendees) comply with this clause.
G2. Prohibited Conduct
The following uses are strictly prohibited:
Creation of content that is sexually explicit, pornographic, or involves nudity, including simulated sexual acts
Content that is obscene, indecent, or grossly offensive
Content that is abusive, threatening, harassing, or discriminatory, including on the grounds of sex, race, disability, religion, sexual orientation, or age
Use intended to insult, humiliate, defame, or intimidate any individual or group
Content that promotes hate, violence, or illegal activity
Use that brings, or is likely to bring, Zinn Photo Booth Hire into disrepute
Use of the Equipment while excessively intoxicated where this creates risk of damage, injury, or inappropriate content
G3. Right to Intervene and Suspend Use
Zinn Photo Booth Hire reserves the right to:
Suspend or restrict use of the Equipment
Delete or withhold content
Terminate the hire early
where, in the Supplier’s reasonable opinion, this clause has been breached or there is a material risk of breach.
No refund (in whole or in part) shall be due where hire is suspended or terminated under this clause. G4. Liability for Breach
The Client shall remain fully liable for:
Any damage to the Equipment
Any losses, claims, complaints, or reputational harm suffered by Zinn Photo Booth Hire
Any legal or regulatory consequences arising from improper use
This applies whether the breach is committed by the Client, their guests, or any third party under their control.
G5. Content Ownership and Retention
Zinn Photo Booth Hire does not accept responsibility for monitoring content in real time.
The Supplier reserves the right to refuse to supply, delete, or permanently withhold any content that breaches this clause or applicable law.
G6. No Waiver
Failure to intervene immediately shall not constitute acceptance or waiver of any breach of this clause.
PART H – Optional USB Guest Book Add-On
H1. Availability
A USB Digital Guest Book may be added to any rental package offered by Zinn Photo Booth Hire, subject to availability.
There is no limit on the quantity of USB guest books that may be ordered per booking, provided sufficient notice is given at the time of booking or as otherwise agreed in writing.
H2. Content
The USB guest book will contain digital content captured during the Event, which may include photographs, videos, GIFs, boomerangs, or similar media generated by the Photo Booth.
The Supplier does not guarantee that every guest will appear in the content or that a minimum quantity of content will be captured.
H3. Production and Delivery Timescale
USB guest books will be processed and dispatched within up to 10 working days after the Event. This timescale reflects post-event processing, quality checks, and handling and shall not be treated as a guaranteed delivery date.
H4. Delivery
The price of the USB guest book includes delivery within the UK.
Delivery will be made to:
The delivery address provided by the Client at the time of booking; or
If no delivery address is provided, the billing address associated with the booking shall be used by default.
The Supplier shall not be responsible for delays or non-delivery caused by incorrect or incomplete address details supplied by the Client.
H5. Risk and Replacement
Risk in the USB guest book passes to the Client upon delivery.
In the event of loss or damage in transit, the Supplier’s liability shall be limited to replacement of the USB device and re-supply of the available content.
H6. Data Retention
Digital content will be retained by Zinn Photo Booth Hire for a limited period following the Event to facilitate production and delivery.
The Supplier does not guarantee long-term storage of event content and strongly recommends that Clients back up their USB guest book upon receipt.
H7. USB Capacity
Each USB Digital Guest Book supplied has a storage capacity of 8GB.
An 8GB USB typically accommodates well over 1,000 high-quality images, or a combination of photos and short video clips from a standard event.
The Supplier will use reasonable efforts to ensure that all usable content captured during the Event is included within this capacity. Where total content exceeds 8GB, the Supplier may:
Apply reasonable compression; and/or
Curate the content to include a representative selection of images and media.
The Supplier is not liable for content omission resulting from storage capacity limits unless otherwise agreed in writing.
PART I – Data Protection (UK GDPR)
Data collected (photos, videos, USB content) is solely for photo booth service delivery.
Data will be stored for up to 10 working days post-Event, to allow for processing, or to respond to add-on requests; long-term storage is not guaranteed.
Data is shared only with Client; not disclosed to third parties without consent or legal obligation. There will be exception to the aforementioned detail where any data is requested to support legal investigations where a crime may have been committed by the photo booth user(s)
Reasonable security measures in place; risk passes to Client on delivery.
Client responsible for obtaining consent from attendees where required.
Marketing use requires explicit opt-in consent by the Client.
PART J – Booking Acceptance
By paying the deposit and confirming the booking, the Client acknowledges:
Reading and acceptance of full Terms & Conditions
Understanding of equipment replacement values
Responsibility for equipment and attendee conduct
Optional Damage Waiver selection
